Getting a 316 shortly. The guy Im buying it from says that is he uses the brakes they will lock-up. Could this be as simple as releasing the parking brake. What position is the parking brake activated. Up or down ? Would love to get may hands on a free operations manual for this tractor.

The brakes on the 316 Onan, 318, 322 and 332 tractors will automatically move the ground speed control to the 'neutral' position when the brake pedals are fully depressed. The hydro drive in the neutral (STOP) position is going to lock up the tires if the tractor was moving...even if the brake pedals were just "tapped" and released. This may be what the current owner is calling a 'lock-up' of the brakes.

If the brake pedals remain in the down position, then perhaps there are some additional linkage or operational issues present.

Chuck has answered your question here pretty well but I would like to add a little more to it. The John Deere 316 brake rod's are adjustable under the floor pan for each wheel as well as the brake shoes one each wheel on the backing plates at the bottom area. There will be an Oval rubber plug installed there. Once you take it out you can adjust the brake shoe amount of Travel of each wheel. Turn the wheel while using a brake spoon or large flat screwdriver to adjust the star wheel inside the backing plate until the wheel begins to drag some as you turn it. They adjust just like an Older car or Truck with brake shoes, The drag noticed while spinning the rear wheel as you adjust the star wheel adjuster will tell you when the brakes are adjusted correctly when they have a slight drag to them when being spun by hand.
